Kiyaga<\/a><\/strong><\/p>\n<p>Buganda es un importante reino subnacional del centro de Uganda. Aunque m\u00e1s de 10 millones de personas viven y trabajan en tierras propiedad del reino, la autoridad de tierras conocida como Buganda Land Board (BLB) s\u00f3lo registra 250.000 entradas de arrendatarios inscritos en su base de datos. Y menos del 5% de los que figuran en la base de datos tienen t\u00edtulos de arrendamiento de tierras. Muchos carecen de fondos y de conocimientos sobre la finalidad de los t\u00edtulos y sobre c\u00f3mo asegurar su tenencia.<\/p>\n<p>En 2010, BLB cre\u00f3 la Iniciativa de Financiaci\u00f3n del Acceso a los T\u00edtulos de Propiedad (LAFI, por sus siglas en ingl\u00e9s) para ayudar a millones de arrendatarios a sufragar el coste de la tramitaci\u00f3n de los t\u00edtulos y, en \u00faltima instancia, a adquirirlos. Las estad\u00edsticas de la base de datos de BLB muestran que solo 26% de los solicitantes de esta iniciativa son mujeres.<\/p>\n<p>Sin embargo, m\u00e1s del 60% de las personas que asisten a los programas de sensibilizaci\u00f3n de LAFI son mujeres, lo que indica que en realidad son m\u00e1s las que utilizan la tierra como factor de producci\u00f3n. Pero mientras que las mujeres son usuarias mayoritarias de la tierra, su propiedad es muy limitada, debido a diferentes factores. Algunas no tienen el m\u00fasculo econ\u00f3mico para ser propietarias, y para otras, la historia cultural as\u00ed lo ha dictado.<\/p>\n<p><strong>El derecho de las mujeres a la tierra: Pol\u00edtica frente a realidad \u00a0<\/strong><\/p>\n<p>En Uganda, <a href=\"http:\/\/mlhud.go.ug\/wp-content\/uploads\/2015\/10\/Gender-Strategy-for-Land-for-NLP-August-2016-Reviewed.doc.pdf\">terrenos registrados<\/a> sigue siendo de 20%, y de esa cifra las mujeres s\u00f3lo representan un exiguo 5%-26%. Es urgente abordar las injusticias hist\u00f3ricas y los legados coloniales, que han dado lugar a varios problemas:<\/p>\n<ul>\n<li>m\u00faltiples derechos e intereses sobre el mismo terreno;<\/li>\n<li>disposici\u00f3n y p\u00e9rdida de tierras por parte de las mujeres;<\/li>\n<li>litigios fronterizos derivados de conflictos tribales, \u00e9tnicos y transfronterizos; y<\/li>\n<li>Mecanismos ineficaces de resoluci\u00f3n de conflictos, que han dado lugar a desalojos ilegales de grupos vulnerables, especialmente ni\u00f1os y mujeres.<\/li>\n<\/ul>\n<p>Por mucho que el gobierno de Uganda se haya comprometido a garantizar los derechos de las mujeres sobre la tierra, existe una brecha flagrante entre el texto pol\u00edtico y jur\u00eddico y la realidad de su aplicaci\u00f3n sobre el terreno. La informaci\u00f3n sobre la tierra suele ser poco fiable, por lo que las decisiones se basan en testimonios humanos y otros medios no documentados.<\/p>\n<p>La falta de fondos para adquirir y pagar la tramitaci\u00f3n de los t\u00edtulos y el desconocimiento de los derechos sobre la tierra tanto en las zonas rurales como en las urbanas -especialmente los derechos sobre la tierra de las mujeres, que a menudo son v\u00edctimas del acaparamiento de tierras y de la inseguridad en la tenencia de la tierra- es uno de los principales obst\u00e1culos que hay que abordar.<\/p>\n<p>Por ejemplo, en Golomolo, Buganda, la poblaci\u00f3n fue desalojada ilegalmente de las tierras en las que hab\u00eda vivido durante generaciones. Las disputas por la tierra y los desalojos provocaron incluso muertes. Muchas personas sufrieron trastornos, sobre todo mujeres y ni\u00f1os. Esto ocurri\u00f3 porque muchos de ellos no ten\u00edan documentaci\u00f3n oficial o incluso extraoficial que garantizara la tenencia. La Junta de Tierras de Buganda, que es la propietaria, intervino para resolver la situaci\u00f3n, pero muchos declararon rotundamente que no conoc\u00edan los procedimientos, mientras que otros confesaron que no pod\u00edan costearse el proceso.<\/p>\n<p><strong>Impacto de la seguridad de la tenencia para las mujeres<\/strong><\/p>\n<p>A pesar de los numerosos obst\u00e1culos, las mujeres de Buganda <em>son<\/em> haciendo progresos. Los testimonios de mujeres que han adquirido t\u00edtulos y mejorado sus medios de vida son escasos, pero muestran un gran impacto:<\/p>\n<ul>\n<li>Solome Nanvule es una mujer soltera que, con mucho esfuerzo, pudo comprar un terreno y tramitar su t\u00edtulo de propiedad. Ahora tiene acceso al cr\u00e9dito y ha podido fundar su escuela de formaci\u00f3n profesional, que se centra en ense\u00f1ar a las adolescentes habilidades para la vida como panader\u00eda, sastrer\u00eda, creaci\u00f3n de cambios positivos e impacto.
