Kiyaga<\/a><\/strong><\/p>\n<p>Le Buganda est un important royaume subnational situ\u00e9 au centre de l'Ouganda. Alors que plus de 10 millions de personnes vivent et travaillent sur des terres appartenant au royaume, l'autorit\u00e9 fonci\u00e8re connue sous le nom de Buganda Land Board (BLB) n'enregistre que 250 000 entr\u00e9es de locataires enregistr\u00e9s dans sa base de donn\u00e9es. Et moins de 5% de ceux qui figurent dans la base de donn\u00e9es poss\u00e8dent des titres fonciers \u00e0 bail. Nombreux sont ceux qui manquent de fonds et de connaissances sur l'utilit\u00e9 des titres et sur la mani\u00e8re de garantir leur location.<\/p>\n<p>En 2010, la BLB a cr\u00e9\u00e9 l'initiative de financement de l'acc\u00e8s aux titres fonciers (LAFI) pour aider des millions de locataires \u00e0 couvrir les frais de traitement des titres et \u00e0 acqu\u00e9rir des titres fonciers. Les statistiques de la base de donn\u00e9es de la BLB montrent que seulement 26% des demandeurs de cette initiative sont des femmes.<\/p>\n<p>Cependant, plus de 60% des personnes qui participent aux programmes de sensibilisation de LAFI sont des femmes, ce qui indique qu'elles sont plus nombreuses \u00e0 utiliser la terre comme facteur de production. Mais si les femmes sont les principales utilisatrices de la terre, la propri\u00e9t\u00e9 fonci\u00e8re des femmes est tr\u00e8s limit\u00e9e, en raison de diff\u00e9rents facteurs. Certaines n'ont pas les moyens \u00e9conomiques de poss\u00e9der des terres, et pour d'autres, c'est l'histoire culturelle qui l'impose.<\/p>\n<p><strong>Les droits fonciers des femmes : Politique et r\u00e9alit\u00e9 \u00a0<\/strong><\/p>\n<p>En Ouganda, <a href=\"http:\/\/mlhud.go.ug\/wp-content\/uploads\/2015\/10\/Gender-Strategy-for-Land-for-NLP-August-2016-Reviewed.doc.pdf\">terrain enregistr\u00e9<\/a> est encore de 20%, et les femmes ne repr\u00e9sentent qu'un maigre 5%-26%. Il est urgent de rem\u00e9dier aux injustices historiques et \u00e0 l'h\u00e9ritage colonial, qui ont engendr\u00e9 plusieurs probl\u00e8mes :<\/p>\n<ul>\n<li>des droits et des int\u00e9r\u00eats multiples sur un m\u00eame terrain ;<\/li>\n<li>l'ali\u00e9nation et la perte de terres par les femmes ;<\/li>\n<li>les diff\u00e9rends frontaliers d\u00e9coulant de groupes tribaux ou ethniques et les diff\u00e9rends frontaliers entre \u00c9tats ; et<\/li>\n<li>des m\u00e9canismes inefficaces de r\u00e9solution des conflits, qui ont entra\u00een\u00e9 des expulsions ill\u00e9gales de groupes vuln\u00e9rables, notamment des enfants et des femmes.<\/li>\n<\/ul>\n<p>Bien que le gouvernement ougandais se soit engag\u00e9 \u00e0 garantir les droits fonciers des femmes, il existe un foss\u00e9 flagrant entre les textes politiques et juridiques et la r\u00e9alit\u00e9 de la mise en \u0153uvre sur le terrain. (Photo par Kimbowa Joseph \/ Buganda Land Board)<\/p><\/div>\n<p>Les femmes sont confront\u00e9es \u00e0 des obstacles importants pour faire valoir leurs droits fonciers et de propri\u00e9t\u00e9 en raison des normes et des pratiques traditionnelles. Les informations fonci\u00e8res sont souvent peu fiables et les d\u00e9cisions sont donc bas\u00e9es sur des t\u00e9moignages humains et d'autres moyens non document\u00e9s.<\/p>\n<p>Le manque de fonds pour acqu\u00e9rir et payer le traitement des titres de propri\u00e9t\u00e9 et le manque de connaissances sur les droits fonciers dans les zones rurales et urbaines - en particulier les droits fonciers des femmes qui sont souvent victimes de l'accaparement des terres et de l'ins\u00e9curit\u00e9 fonci\u00e8re - est l'un des principaux obstacles qui doivent \u00eatre surmont\u00e9s.<\/p>\n<p>Prenons l'exemple de Golomolo, au Buganda, o\u00f9 des personnes ont \u00e9t\u00e9 expuls\u00e9es ill\u00e9galement des terres sur lesquelles elles vivaient depuis des g\u00e9n\u00e9rations. Les querelles fonci\u00e8res et les expulsions ont m\u00eame entra\u00een\u00e9 des d\u00e9c\u00e8s. De nombreuses personnes ont \u00e9t\u00e9 perturb\u00e9es, en particulier des femmes et des enfants. Cela s'est produit parce que beaucoup d'entre eux n'ont pas de documents officiels ou m\u00eame officieux garantissant la location. Le Buganda Land Board, en tant que propri\u00e9taire, est intervenu pour r\u00e9soudre la situation, mais beaucoup ont d\u00e9clar\u00e9 d'embl\u00e9e qu'ils ne connaissaient pas les proc\u00e9dures, tandis que d'autres ont avou\u00e9 qu'ils n'en avaient pas les moyens.<\/p>\n<p><strong>Impact de la s\u00e9curit\u00e9 d'occupation pour les femmes<\/strong><\/p>\n<p>Malgr\u00e9 les nombreux obstacles, les femmes du Buganda <em>sont<\/em> des progr\u00e8s. Les t\u00e9moignages de femmes qui ont acquis des titres et am\u00e9lior\u00e9 leurs moyens de subsistance sont peu nombreux, mais leur impact est consid\u00e9rable :<\/p>\n<ul>\n<li>Solome Nanvule est une femme c\u00e9libataire qui, \u00e0 force de travail, a pu acheter un terrain et obtenir un titre de propri\u00e9t\u00e9. Elle a maintenant acc\u00e8s au cr\u00e9dit et a pu cr\u00e9er son \u00e9cole professionnelle qui se concentre sur l'enseignement aux adolescentes de comp\u00e9tences de vie telles que la boulangerie, la couture, la cr\u00e9ation de changements positifs et l'impact.
