Lorsque Stand For Her Land Tanzania s'est associ\u00e9 \u00e0 l'\u00e9quipe qui a cr\u00e9\u00e9 l'application mobile d'aide juridique Sheria Kiganjani - \"La loi sur votre paume\" en swahili - pour d\u00e9velopper un outil de suivi et de protection des droits fonciers des femmes en Tanzanie, le COVID-19 \u00e9tait encore digne d'un film hollywoodien. Quelques mois seulement apr\u00e8s le lancement du segment S4HL de l'application Sheria Kiganjani, ses concepteurs travaillent avec Landesa, en tant que secr\u00e9tariat de la campagne, pour int\u00e9grer des messages sur la protection des droits fonciers des femmes, ainsi que d'autres informations sur la sant\u00e9 et la s\u00e9curit\u00e9, dans le contexte de la pand\u00e9mie.<\/p>\n

Revenant sur le d\u00e9but de leur histoire, l'\u00e9quipe d'entrepreneurs sociaux, de concepteurs num\u00e9riques et d'experts juridiques de Sheria Kiganjani a lanc\u00e9 son application mobile fin 2018 afin d'apporter des services et des informations juridiques indispensables aux Tanzaniens vivant dans des communaut\u00e9s et des zones rurales. Dans tout le pays, l'acc\u00e8s \u00e0 la justice et la sensibilisation aux droits juridiques li\u00e9s \u00e0 la terre, au mariage, \u00e0 l'h\u00e9ritage et \u00e0 d'autres questions urgentes peuvent faire d\u00e9faut.<\/p>\n

Sheria Kiganjani est la premi\u00e8re plateforme juridique num\u00e9rique en ligne en Tanzanie qui comble ce foss\u00e9 en connectant \u00e0 distance les personnes aux services juridiques et aux informations dont elles ont besoin. Jusqu'\u00e0 pr\u00e9sent, l'application a permis de r\u00e9soudre quelque 1 500 affaires juridiques, dont pr\u00e8s d'un tiers concerne les droits fonciers.<\/p>\n

L'un de ces cas est celui de Saida.<\/p>\n

Saida \u00e9tait une jeune fille lorsqu'elle a \u00e9t\u00e9 forc\u00e9e de se marier \u00e0 l'\u00e2ge de 13 ans. Elle n'a pas connu ses droits pendant les huit ann\u00e9es qu'a dur\u00e9 son mariage abusif avec un homme beaucoup plus \u00e2g\u00e9 qu'elle. \u00c0 la mort de ce dernier, les proches de son mari ont tout pris, m\u00eame la terre, sous pr\u00e9texte qu'en tant que femme, elle n'avait pas le droit d'h\u00e9riter de biens. Ne connaissant pas ses droits, n'ayant pas acc\u00e8s \u00e0 un avocat et n'ayant pas les moyens de s'en payer un, elle s'est retrouv\u00e9e sans aucune aide.<\/p>\n

\"Saida et 22 millions de Tanzaniens sont confront\u00e9s chaque jour \u00e0 un manque d'acc\u00e8s \u00e0 la justice en raison de contraintes financi\u00e8res et autres\", a d\u00e9clar\u00e9 Neema Magimba, responsable du service juridique de Sheria Kiganjani. \"Nous pensons que tout le monde a le droit d'acc\u00e9der \u00e0 la justice facilement et \u00e0 un prix abordable, c'est pourquoi nous avons cr\u00e9\u00e9 Law On Your Palm.<\/p>\n

Peu apr\u00e8s la cr\u00e9ation de Stand For Her Land Tanzania en 2019, la campagne a travaill\u00e9 avec Sheria Kiganjani, aujourd'hui membre de l'organisation forte de 25 membres.\u00a0S4HL coalition tanzanienne<\/a>La Commission europ\u00e9enne a donc d\u00e9cid\u00e9 de cr\u00e9er un segment de l'application consacr\u00e9 uniquement aux d\u00e9fis uniques auxquels les femmes comme Saida sont confront\u00e9es pour acc\u00e9der \u00e0 leurs droits fonciers garantis.<\/p>\n

\"ShowingApr\u00e8s le lancement du segment S4HL, le secr\u00e9tariat de la campagne, Landesa Tanzania, en collaboration avec Sheria Kiganjani, a men\u00e9 un projet pilote dans trois villages, en formant des observateurs des droits fonciers, \u00e9galement connus sous le nom de parajuristes communautaires, \u00e0 l'utilisation du segment S4HL pour collecter des donn\u00e9es sur les cas n\u00e9cessitant une attention particuli\u00e8re, \u00e0 l'utilisation de l'outil pour sensibiliser les femmes aux lois qui prot\u00e8gent leurs droits fonciers et \u00e0 la mani\u00e8re d'acc\u00e9der au syst\u00e8me judiciaire pour les faire respecter. Pr\u00e8s de 120 cas ont \u00e9t\u00e9 r\u00e9solus jusqu'\u00e0 pr\u00e9sent gr\u00e2ce au projet pilote, et l'\u00e9quipe a l'ambition d'\u00e9tendre le projet \u00e0 l'\u00e9chelle nationale d\u00e8s qu'elle en aura les moyens.<\/p>\n

Lorsque la pand\u00e9mie de coronavirus a frapp\u00e9, les membres de S4HL Tanzanie, Sheria Kiganjani et Landesa, ont r\u00e9agi rapidement pour relever ce nouveau d\u00e9fi. Fin mai, des parajuristes communautaires ont \u00e9t\u00e9 form\u00e9s par t\u00e9l\u00e9phone \u00e0 la sensibilisation, \u00e0 la collecte et au partage d'informations sur l'impact du COVID-19 sur les droits fonciers des femmes - et surtout des veuves, qui sont particuli\u00e8rement menac\u00e9es dans un contexte de crise.<\/p>\n

La protection des droits fonciers des femmes est actuellement tr\u00e8s difficile sur le terrain en raison des restrictions de mouvement li\u00e9es \u00e0 la pand\u00e9mie\", a d\u00e9clar\u00e9 Khadija Mrisho, analyste des r\u00e9gimes fonciers \u00e0 Landesa et membre de la campagne \"Stand For Her Land\" (D\u00e9fendez vos terres).<\/p>\n

\"Dans le m\u00eame temps, les gens continuent \u00e0 vivre leur vie quotidienne. Des gens mourront et des femmes seront toujours sur le point de perdre leurs droits de succession en raison des pratiques et des coutumes qui seront toujours appliqu\u00e9es. Mais aujourd'hui, les services juridiques sur le terrain leur sont encore plus inaccessibles \u00e0 cause de COVID-19\", a-t-elle ajout\u00e9.<\/p>\n

C'est le cas d'une veuve qui a r\u00e9cemment signal\u00e9 au secr\u00e9tariat de S4HL Tanzanie qu'un parent masculin avait ill\u00e9galement revendiqu\u00e9 ses terres et ses biens dans une r\u00e9gion \u00e0 laquelle elle ne peut actuellement pas acc\u00e9der en raison de la pand\u00e9mie. Les membres de la campagne s'attendent \u00e0 d'autres violations des droits fonciers des femmes au fur et \u00e0 mesure que la pand\u00e9mie se propage dans le pays. In\u00e9vitablement, il en r\u00e9sultera une augmentation du nombre de veuves et, par cons\u00e9quent, une augmentation du nombre de femmes vuln\u00e9rables \u00e0 de tels accaparements de terres.<\/p>\n

En plus d'int\u00e9grer le nouveau contenu COVID-19 dans le segment S4HL de l'application, l'\u00e9quipe a con\u00e7u des messages SMS en vrac et des messages d'int\u00e9r\u00eat public qui sont diffus\u00e9s sur la radio nationale, afin d'atteindre le plus grand nombre de femmes possible dans tout le pays avec des informations vitales sur la pand\u00e9mie, la fa\u00e7on de pr\u00e9venir sa propagation et la fa\u00e7on dont elle est li\u00e9e aux droits fonciers des femmes.<\/p>\n
