OVERVIEW

In South Sudan, the current land legal framework enshrined under Article 16 of the Transitional Constitution (as amended 2011) and the Land Act 2009 explicitly guarantee women's equal land rights, however the reality on ground and the spirit behind the legal provisions lie a huge implementation gap.

S4HL South Sudan plans to bridge the gap between the existing statutory legal framework and entrenched social norms aliening women from the land question by capacity strengthening and professionalization of customary justice systems, amplify grassroot women’s collective voices on Women’s Land Rights, as well as navigating sustainable justice through Alternative Dispute Resolution (ADR) mechanism to settle land conflicts.

It's worth noting that for the coalition’s aspirations to be achieved, the plans ought to measure up with some recognizable catalytic factors, namely: the exponential government employees’ turn-over (technocrats and constitutional postholder) under both Revitalized Transitional Government of National Unity and the current caretaker government and navigate the missed opportunity with the failure to the implementation of critical chapters (chapter 4&5) under the Revitalized Agreement on the Resolution of the Conflict in South Sudan-RARCSS. The current context does present a window for the coalition to make great strides including advocating for the domestication of the Maputo Protocol into South Sudan’s statutory legal framework as well as the dissemination of South Sudan Women's Land Rights Agenda supported by IGAD.
